Buying Property in the Cayman Islands Step by Step: Offer, Financing, Completion, Stamping and Registration

Buying property in the Cayman Islands runs from a binding offer-to-purchase through financing, valuation and legal due diligence to completion, stamping and registration at the Land Registry, usually within 30 to 45 days when a bank is involved. There is no restriction on foreign buyers, title is registered and backed by a Government guarantee under the Registered Land Act, and the buyer's largest single cost is stamp duty at 7.5% of the consideration (10% from CI$2,000,000). This guide walks the process step by step with the source for each fact, and hands off to the property closing-costs calculator for the cash flow on the day.

Before the offer: who buys, and with what

Anyone may buy. Ogier's April 2026 guide states that "foreign individuals do not need a government licence to buy real estate in the Cayman Islands", and Appleby's 2025 guide that "there are generally no restrictions on foreign ownership of real estate". The foreign buyer spoke covers the formalities that do apply, chiefly for companies and for financing.

Most residential property is listed through members of the Cayman Islands Real Estate Brokers Association (CIREBA) (Corcoran Cayman), and priced in US dollars. Duty and government fees are assessed in Cayman Islands dollars at the fixed rate of CI$1 to US$1.20. Where a mortgage is needed, banks publish maximum loan-to-value ratios rather than rates: Butterfield up to 85%, RBC up to 80% (a 20% minimum down payment), Cayman National up to 95% for Caymanians and 90% for work-permit holders, Scotiabank "as little as 10% down", PROVEN Bank up to 90%. Step 1: the offer to purchase

Offers on CIREBA-listed property are made on the association's standard offer-to-purchase form. Once accepted it "becomes a binding contract", as Cayman Islands Sotheby's International Realty puts it, and the form carries the conditions the buyer needs: a financing condition, an inspection condition, and the completion date. There is no separate exchange of contracts as in England; the accepted offer is the contract.

A deposit accompanies the offer. Published brokerage guides put it at 5% to 10% (Crighton Properties, December 2025), 10% (Property Cayman), or 10% to 20% (Corcoran Cayman). The deposit is held in escrow by the buyer's attorney until completion and, under the standard form, may be forfeited if the buyer fails to complete after a completion notice is served. The closing-costs calculator treats the deposit as paid at signing and deducts it from the balance due on completion.

Step 2: the attorney

The Cayman Islands have no title insurance and no independent escrow agents; the attorney performs both functions. Property Cayman's guide notes that "there is no title insurance covering title defects or escrow officers who act as an independent third party", which is why every published guide expects the buyer to instruct an attorney. The attorney searches the Land Register, registers a stay to freeze the title for fourteen days around completion, reviews the strata by-laws where the property is a strata lot, prepares the transfer and charge, holds the deposit and the completion funds, pays the stamp duty and lodges the documents for registration.

Published fee indications are 0.5% to 1% of the purchase price (Property Cayman; Provenance Properties) or "approximately 1%" (Crighton Properties). There is no prescribed scale, so the calculator takes the quote the buyer is given and labels it as such.

Step 3: financing and valuation

Where the purchase is financed, the bank requires a valuation from an approved valuer. Provenance Properties puts the cost at "starting from approximately CI$400" depending on the size and value of the property; Cayman Resident's February 2026 page says "in the region of CI$700". The valuation matters twice: it caps the loan (Butterfield lends against "the purchase price or appraised value of the property, whichever is less"), and the Lands and Survey Department values every transfer for duty, so a valuation above the price raises the duty base.

Provenance Properties describes the approval process as taking "four to six weeks from the time of application", which is why the financing condition in the offer is usually the longest. Banks require a homeowners' policy with hurricane cover assigned to the bank (RBC; Cayman National lists "fire and hurricane insurance") and life insurance for not less than the mortgage amount (RBC). The bank's own fees are itemised in the mortgage spoke; Scotiabank's published schedule, for example, charges a 1% application fee and a 1% commitment fee with a CI$250 minimum.

Step 4: due diligence

For a strata lot, the by-laws, the strata corporation's insurance summary, recent meeting minutes, the reserve fund position and any pending special assessment are the documents that decide what the fee buys and what risk sits behind it; the strata spoke lists them. For a house or land, the Land Register entry, the registered plan, any registered easements or restrictive agreements, and planning permission for any building work under the Development and Planning Act (2021 Revision), which the Central Planning Authority administers, are the corresponding checks. Where a company rather than a person is the seller, the share-transfer route described in the foreign buyer spoke attracts its own tax.

Step 5: completion

On the completion date the attorney pays the balance of the price to the seller's attorney, the bank advances the loan against the executed charge, and the transfer is executed. The buyer's cash on the day is the balance of the price after deposit and loan, plus the closing costs: stamp duty on the transfer, stamp duty on the charge, the attorney's fee, the bank's fees, the registry fees and, for a strata lot, the first strata payment and any apportionment of fees the seller has prepaid. Step 6: stamping

The transfer and the charge are stamped at the Lands and Survey Department, which assesses and collects duty for the Commissioner of Stamp Duty. The Department's own page states that duty "is payable upon execution of the document, and should be presented to the Lands and Survey Department immediately thereafter", and that interest runs on duty outstanding after 45 days at 10% per annum for the first month and 20% per annum thereafter. The rates are 7.5% of the consideration on the transfer (10% at CI$2,000,000 or more), and 1% or 1.5% of the sum secured on the charge; the stamp duty spoke and the calculator cover the bands and the Caymanian concessions.

Step 7: registration

Title in the Cayman Islands is registered, not deed-based. The Lands and Survey Department's FAQ states that "under the Registered Land Law, the Cayman Islands Government guarantees Title, and hence you do not need to hold a Certificate to prove Title to the Land". The documents must be lodged "no later than 45 days after the date of first signature"; a late registration fee equal to the original fee applies for each further 45-day period, and documents are registered in strict order of receipt. The registry's published fees are modest: CI$50 for a transfer, CI$50 for a charge, CI$50 for a discharge, and CI$20 for a certified copy of the register. Trident Properties describes title as transferred "within approximately three weeks" of lodging.

How long the whole thing takes

Crighton Properties' December 2025 guide says "most purchases close within 30 to 45 days of an accepted offer when bank financing is involved"; ERA Cayman puts non-resident closings at 30 to 90 days, reflecting overseas funds, notarisation and bank underwriting. A cash purchase with no strata complications can be quicker; a purchase conditional on planning permission or on the sale of another property is set by those conditions.

After completion

There is no annual property tax; PwC's Cayman summary (reviewed 29 May 2026) states that "there are no property taxes in the Cayman Islands". The recurring costs are the strata fee where applicable, the home insurance the bank requires, utilities (the Water Authority's residential rate is CI$4.47 per cubic metre for the first 12 cubic metres from 1 July 2026, per Cayman News Service), and the mortgage.
